Software License Agreement of Property Profit Maximizer (aka PPM-Flip) for iPhone™, iPod™, and
iPad™.

Please read this software license agreement ("License") carefully before using the BzarApps LLC software ("Software") known as Property Profit Maximizer (aka PPM-Flip). By using the BzarApps LLC software, you are agreeing to be bound by the terms of this License. BzarApps Software License of Property Profit Maximizer (aka PPM-Flip) is a legal agreement between you (either an individual or a single entity and BzarApps LLC. If you do not agree to the terms of this License, do not use the software. If the BzarApps LLC software was accessed electronically, click
"disagree/decline".

Important Note: To the extent that this software may be used to reproduce materials, it is licensed to you only for reproduction of non-copyrighted materials, materials in which you own the copyright, or materials you are authorized or legally permitted to reproduce. If you are uncertain about your right to copy or permit access to any material you should contact your legal advisor.

1. General.
The BzarApps LLC Software, documentation and any fonts accompanying this License whether on disk, in read only memory, on any other media or in any other form (collectively the BzarApps LLC Software) are licensed, not sold, to you by BzarApps LLC. BzarApps LLC for use only under the terms of this License, and BzarApps LLC reserves all rights not expressly granted to you. The terms of this License will govern any software upgrades provided by BzarApps LLC that replace and/or supplement the original BzarApps LLC Software product, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.

All title, including but not limited to copyrights, in and to the BzarApps LLC software product and any copies thereof are owned by BzarApps LLC.

Title and intellectual property rights in and to any content displayed by or accessed through the BzarApps LLC Software belongs to the respective content owner. Such content may be protected by copyright or other intellectual property laws and treaties, and may be subject to terms of use of a third party providing such content. This License Agreement does not grant you any rights to use such content. All rights not expressly granted are reserved by BzarApps LLC.

2. Permitted License Uses and Restrictions.
A. Subject to the terms and conditions of this License, you are granted a limited non-exclusive license to install and use the BzarApps LLC Software on a single "iPhone™, iPod ™, or iPad ™" device. To the extent that the BzarApps LLC Software may be used to reproduce materials, such use is limited to reproduction of non-copyrighted materials, materials in which you own the copyright, or materials you are authorized or legally permitted to reproduce. You may not make the BzarApps LLC Software available over a network where it could be used by multiple computers at the same time.

B. You may not and you agree not to, or to enable others to, copy (except as expressly permitted by this License), decompile, reverse engineer, disassemble, attempt to derive the source code of, decrypt, modify, create derivative works of the BzarApps LLC Software, or any part thereof. Any attempt to do so is a violation of the rights of BzarApps LLC and its licensors of the BzarApps LLC Software.

3. Transfer.
You may not rent, lease, lend, redistribute or sublicense the BzarApps LLC Software.

4. Termination.
This License is effective until terminated. Your rights under this License will terminate automatically without notice from BzarApps LLC if you fail to comply with any term(s) of this License. Upon the termination of this License, you must cease all use of the BzarApps LLC Software and destroy all copies, full or partial, of the BzarApps LLC Software. Sections 4, 5, 6, 8 and 9 of this License shall survive any such termination.

5. Disclaimer of Warranties.
A. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, USE OF THE BzarApps LLC SOFTWARE AND SERVICES IS AT YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE, ACCURACY AND EFFORT IS WITH YOU.

B. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE BzarApps LLC SOFTWARE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND BzarApps LLC AND BzarApps LLC LICENSORS (COLLECTIVELY REFERRED TO AS " BzarApps LLC " FOR THE PURPOSES OF SECTIONS 5 AND 6) HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE BzarApps LLC SOFTWARE AND SERVICES, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

C. BzarApps LLC DOES NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT AND OR YOUR FINANCIAL SUCCESS OF THE BzarApps LLC SOFTWARE AND SERVICES, THAT THE FUNCTIONS CONTAINED IN OR SERVICES PERFORMED BY THE BzarApps LLC SOFTWARE WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE BzarApps LLC SOFTWARE AND SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY SERVICE WILL CONTINUE TO BE MADE AVAILABLE, THAT DEFECTS IN THE BzarApps LLC SOFTWARE OR SERVICES WILL BE CORRECTED, OR THAT THE BzarApps LLC SOFTWARE WILL BE COMPATIBLE OR WORK WITH ANY THIRD PARTY SOFTWARE, APPLICATIONS OR THIRD PARTY SERVICES. INSTALLATION OF THIS SOFTWARE MAY AFFECT THE USABILITY OF THIRD PARTY SOFTWARE, APPLICATIONS OR THIRD PARTY SERVICES.

D. YOU ACKNOWLEDGE THAT BzarApps LLC ACCEPTS NO LIABILITY FOR LOSS OF PROFIT, OR SPECIAL, OR INCIDENTAL OR CONSEQUENTIAL DAMGAGES OR OTHER SIMILAR CLAIMS ARISING FROM THE USE OF THIS SOFTWARE. IT IS YOUR RESPONSIBILITY AS THE USER OF THIS SOFTWARE TO VERIFY THE ACCURACY OF THE OUTPUT CREATED BY THIS SOFTWARE. AS THE USER OF THIS SOFTWARE, YOU ARE REPONSIBLE FOR DETERMINING ALL OF THE INPUT DATA ASSUMPTIONS THAT AFFECT THE FUTURE PROJECTIONS. THIS SOFTWARE DOES NOT PURPORT TO PREDICT THE FUTURE. THE REPORTS AND GRAPHS GENERATED BY THIS SOFTWARE ARE MEANT TO ASSIST IN THE FINANCIAL ANALYSIS OF REISDENTIAL AND COMMERCIAL INVESTMENT PROPERTY. THIS SOFTWARE WAS NOT DESIGNED TO, NOR IS IT CAPABLE OF ANALYYZING ALL OF THE FACTORS THAT AFFECT THE FUTURE VALUE AND FUTURE RETURNS OF INVESTMENT PROPERTY. MANY FACTORS AFFECT THE RETURN ON INVESTMENT PROPERTY SUCH AS LOCATION, CRIME, UPKEEP, QUALITY OF MANAGEMENT, AGE, PHYSICAL DETERIORATION, CHANGES IN EMPLOYMENT TRENDS, THE COST OF BUILDING MATERIALS, ETC. THE PURCHASE OF THIS SOFTWARE PROVIDES NO PROTECTION FROM UNITED STATES OR ANY GOVERNING BODY TAX LAW. AS A SUPPLEMENT TO THE FINANCIAL ANALYSIS PROVIDED BY THIS SOFTWARE, IT IS HIGHLY RECOMMENDED THAT YOU SEEK THE SERVICES AND OPINION OF REAL ESTATE PROFESSIONALS. THE RESPONSIBILITY AND DECISION TO PURCHASE INVESTMENT PROPERTY IS YOURS AND YOURS ALONE.

E. YOU FURTHER ACKNOWLEDGE THAT THE BzarApps LLC SOFTWARE AND SERVICES ARE NOT INTENDED OR SUITABLE FOR USE IN SITUATIONS OR ENVIRONMENTS WHERE THE FAILURE OR TIME DELAYS OF, OR ERRORS OR INACCURACIES IN, THE CONTENT, DATA OR INFORMATION PROVIDED BY THE BzarApps LLC SOFTWARE OR SERVICES COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE, INCLUDING WITHOUT LIMITATION THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL, LIFE SUPPORT OR WEAPONS SYSTEMS.

F. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY BzarApps LLC OR A BzarApps LLC AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE BzarApps LLC SOFTWARE OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

6. Limitation of Liability.
TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, IN NO EVENT SHALL BzarApps LLC BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL SAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, CORRUPTION OR LOSS OF DATA, FAILURE TO TRANSMIT OR RECEIVE ANY DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE BzarApps LLC SOFTWARE OR SERVICES OR ANY THIRD PARTY SOFTWARE OR APPLICATIONS IN CONJUNCTION WITH THE BzarApps LLC SOFTWARE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF BzarApps LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event shall BzarApps LLC total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the cost of the purchase of the software program. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

7. Government End Users.
The BzarApps LLC Software and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. Unpublished-rights reserved under the copyright laws of the United States.

8. Controlling Law and Severability.
This License will be governed by and construed in accordance with the laws of the State of Arizona, excluding its conflict of law principles. This License shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. If for any reason a court of competent jurisdiction finds any provision, or portion thereof, to be unenforceable, the remainder of this License shall continue in full force and effect.

9. Complete Agreement; Governing Language.
This License constitutes the entire agreement between the parties with respect to the use of the BzarApps LLC Software licensed hereunder and supersedes all prior or contemporaneous understandings regarding such subject matter, with the exception of any additional terms and conditions you are required to accept if you choose to use any of BzarApps LLC owned online store(s) which will govern your use of such store and any Services you purchase through that store. No amendment to or modification of this License will be binding unless in writing and signed by BzarApps LLC. Any translation of this License is done for local requirements and in the event of a dispute between the English and any non-English versions, the English version of this License shall govern, to the extent not prohibited by local law in your jurisdiction.
